Section 1 - Online Store Terms
By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence and that you have granted us permission to allow any of your minor dependents to use this site.
You must not use our products for any illegal or unauthorized purposes, nor violate any laws in your jurisdiction (including copyright laws) while using our Service. Transmitting any worms, viruses, or malicious code is strictly prohibited. A breach of any of these Terms will result in immediate termination of your access to the Service.
Section 2 - General Conditions
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted across various networks and may be modified to comply with technical requirements of connecting devices or networks. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.
The headings used in this agreement are included for convenience only and will not limit or affect these Terms.
Section 3 - Accuracy, Completeness, and Timeliness of Information
We are not responsible for the accuracy, completeness, or timeliness of the information on this site. The material on this site is provided for general informational purposes and should not be solely relied upon for making decisions. Any reliance on the material on this site is at your own risk.
This site may contain historical information that is not current and is provided for reference only. We reserve the right to modify the content of this site at any time but are under no obligation to update any information.
Section 4 - Modifications to the Service and Prices
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any part of the Service at any time without prior notice. We are not liable to you or any third party for any changes, price adjustments, suspension, or discontinuance of the Service.
Section 5 - Products or Services
Certain products or services may be available exclusively online through our website. These items may have limited quantities and are subject to our Return Policy.
We make every effort to display our products' colors and images as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual colors.
We reserve the right to limit sales of our products or services to any individual, geographic region, or jurisdiction. We reserve the right to limit quantities, discontinue any product, and change product descriptions and pricing at any time without notice. Any offers on this site are void where prohibited.
We do not warrant that the quality of any products, services, or information purchased or obtained by you will meet your expectations or that any errors in the Service will be corrected.
Section 6 - Accuracy of Billing and Account Information
We reserve the right to refuse any order at our discretion. We may limit or cancel quantities purchased per person, household, or order. If we make changes to or cancel an order, we may notify you using the contact details provided at the time of purchase.
You agree to provide current, complete, and accurate purchase and account information for all purchases and to promptly update your account information as needed.
Section 7 - Subscriptions
Some of our products are available on a subscription basis, meaning they will be automatically fulfilled and charged to your payment method on a recurring schedule until you cancel.
By purchasing a subscription, you authorize us to charge your payment method on a recurring basis at the then-current subscription price. We will notify you of any changes to your subscription price before they take effect.
You may cancel your subscription at any time by contacting us at hello@forchics.com or through your account settings. Cancellations must be submitted before the next billing date to avoid being charged for the following cycle. Cancellation stops future charges but does not entitle you to a refund for any subscription period already paid.
We reserve the right to modify, suspend, or discontinue subscription offerings at any time with reasonable notice.
Section 8 - Optional Tools
We may provide you with access to third-party tools over which we have no control or input. You acknowledge and agree that we provide access to these tools "as is" and "as available," without any warranties of any kind. We are not liable for any issues arising from your use of optional third-party tools. Any use of these tools is entirely at your own risk.
Section 9 - Third-Party Links
Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for evaluating the content or accuracy of such sites and assume no liability for third-party materials or websites. Please review the policies of any third parties before engaging in transactions with them.
Section 10 - User Comments, Feedback, and Other Submissions
If you provide us with feedback, ideas, or other submissions, you agree that we may use and distribute these without restriction, compensation, or obligation of confidentiality. You are solely responsible for any comments you make and their accuracy. Comments must not infringe third-party rights or contain unlawful, abusive, or obscene material.
Section 11 - Personal Information
Your submission of personal information through our store is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Section 12 - Errors, Inaccuracies, and Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping, or availability. We reserve the right to correct any errors and to update or cancel orders where information is inaccurate, without prior notice.
Section 13 - Prohibited Uses
In addition to the prohibitions set out in these Terms, you are prohibited from using the site or its content for any unlawful purpose, to infringe upon intellectual property rights, to harass or harm others, to submit false or misleading information, or to upload malicious code. We reserve the right to terminate your use of the Service for any violation of these prohibited uses.
Section 14 - Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free. The Service and all products delivered through it are provided "as is" and "as available" without any warranties of any kind, either express or implied, including implied warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by applicable law, ForChics (HDH ECOM INC), our directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service or its products. In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability for certain damages, our liability shall be limited to the maximum extent permitted by law.
Section 15 - Indemnification
You agree to indemnify and hold ForChics (HDH ECOM INC), our affiliates, officers, directors, agents, employees, and partners harmless from any claims, demands, losses, or damages, including reasonable attorneys' fees, arising from your breach of these Terms or violation of any law or third-party rights.
Section 16 - Shipping and Payment Disputes
Shipping times may vary. In rare cases involving holidays or unexpected events, delivery may take longer than estimated.
If you experience any issue with your order or payment, please contact us first at hello@forchics.com. We ask that you give us a reasonable opportunity to resolve the issue before contacting your bank or card issuer. We are committed to working with you to find a fair resolution. This is a request, not a binding waiver of any statutory rights you may have.
Section 17 - Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity and enforceability of the remaining provisions. Any severed provision shall be enforced to the maximum extent permitted by applicable law. The sole exception is Section 20.7 (Class Action Waiver), which is governed by the non-severability rule set forth in that Section.
Section 18 - Term and Termination
18.1 Term. These Terms take effect when you first access or use the Service and remain in effect until terminated in accordance with this Section.
18.2 Termination by You. You may terminate these Terms at any time by ceasing all use of the Service and, if you hold an account, closing that account. Termination does not, by itself, cancel any active subscription. To cancel a subscription, follow the process described in Section 7.
18.3 Termination or Suspension by Us. We may suspend or terminate your access to all or any part of the Service, refuse any current or future order, or close your account, at any time and without prior notice, if we reasonably determine that you have breached these Terms, engaged in fraudulent, abusive, or unlawful activity, initiated repeated or bad-faith payment disputes, or used the Service in a manner that creates risk or legal exposure for us or for other users. Where practicable and not prohibited by law, we will notify you at the email address associated with your account.
18.4 Effect of Termination. Upon termination, your right to access and use the Service ceases immediately. Termination does not affect any order already accepted and paid for, which will be fulfilled or refunded in accordance with our Return and Refund Policy, and does not relieve you of any payment obligation incurred before termination.
18.5 Survival. The following provisions survive any termination or expiration of these Terms: Section 10 (User Comments, Feedback, and Other Submissions), Section 14 (Disclaimer of Warranties; Limitation of Liability), Section 15 (Indemnification), Section 17 (Severability), this Section 18.5, Section 19 (Governing Law and Venue), Section 20 (Dispute Resolution and Binding Arbitration), Section 22 (Entire Agreement; Assignment; No Waiver), and any other provision that by its nature should survive.
Section 19 - Governing Law and Venue
19.1 Governing Law. These Terms, and any dispute arising out of or relating to these Terms or the Service, are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
19.2 Venue. Subject to Section 20 (Dispute Resolution and Binding Arbitration), any claim not subject to arbitration shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and we consent to the personal jurisdiction of those courts and waive any objection based on venue or forum non conveniens.
19.3 Consumer Protections Not Waived. Nothing in these Terms waives, limits, or restricts any right or remedy available to you under the consumer protection laws of your state or country of residence that cannot be waived by agreement.
Section 20 - Dispute Resolution and Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. SECTION 20.9 EXPLAINS HOW TO OPT OUT WITHIN 30 DAYS.
20.1 Scope. You and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any product purchased from us, any subscription or recurring charge, any marketing or advertising communication, or the collection or use of your personal information (each, a "Dispute") will be resolved as set out in this Section. This Section applies to claims arising before the date you accepted these Terms only to the extent permitted by applicable law.
20.2 Exclusions. This Section does not apply to: (a) any individual claim brought in a small claims court of competent jurisdiction, so long as it remains an individual claim in that court; (b) any claim to enforce or protect intellectual property rights; or (c) any claim for public injunctive relief, which is addressed in Section 20.8.
20.3 Mandatory Informal Resolution. Before initiating arbitration, the party raising the Dispute must first send a written Notice of Dispute to hello@forchics.com and attempt informal resolution in good faith for 60 days. A Notice of Dispute sent by you must include your full name, the email address associated with your order, the order number(s) at issue, a description of the nature and basis of the claim, the specific relief sought, and your personal signature. A notice signed only by counsel, or submitted on a form that does not contain the individually specific information above, does not satisfy this Section. You and we agree to engage in a good-faith individualized telephone or videoconference settlement conference during the 60-day period if either party requests one. The statute of limitations and any arbitration filing-fee deadline are tolled during this period. Completion of this process is a condition precedent to commencing arbitration.
20.4 Arbitration Provider and Rules. If the Dispute is not resolved within 60 days, it shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and, where applicable by their terms, its Mass Arbitration Supplementary Rules, as modified by this Section. The Federal Arbitration Act governs the interpretation and enforcement of this Section. If AAA is unavailable or declines to administer, the parties shall agree on a substitute provider with equivalent consumer and mass-arbitration protocols, or a court of competent jurisdiction shall appoint one.
20.5 Arbitration Procedure. The arbitration shall be conducted by a single neutral arbitrator. Unless the parties agree otherwise, any in-person hearing shall take place in the county of your residence, and either party may elect a documents-only or telephonic proceeding. The arbitrator may award any relief available to an individual party in court under applicable law, and shall issue a reasoned written decision. The arbitrator's award is final and binding, and judgment may be entered in any court of competent jurisdiction.
20.6 Coordinated Proceedings. If 25 or more demands for arbitration of a substantially similar nature are filed against us by or with the assistance of the same law firm or coordinated group of counsel within a 90-day period, the demands shall be administered as follows: (a) Counsel shall group the demands into batches of no more than 50, and the parties shall select an initial bellwether batch of no more than 20 demands to be arbitrated first, with each side selecting half. (b) All remaining demands shall be stayed, and all applicable limitations periods and filing deadlines shall be tolled for those demands during the stay. (c) Following resolution of the bellwether batch, the parties shall participate in a global mediation before a mutually agreed mediator prior to any further batch proceeding. (d) Fees for stayed demands are not incurred and are not due while the stay is in effect.
20.7 Class Action Waiver and Non-Severability. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of class or representative proceeding, except as expressly provided in Section 20.6.
Notwithstanding Section 17 (Severability), if this Section 20.7 is found to be unenforceable or invalid as to any claim or request for relief, then the entirety of Section 20 shall be null and void as to that claim or request for relief, and that claim or request for relief shall proceed exclusively in the courts identified in Section 19.2. In no event shall any class, collective, or representative proceeding be arbitrated.
20.8 Public Injunctive Relief. If a claim for public injunctive relief is asserted, and applicable law provides that such a claim may not be waived or compelled to arbitration, that claim alone shall be severed and stayed pending completion of arbitration of all other claims, and shall then proceed in the courts identified in Section 19.2. All other claims remain subject to arbitration.
20.9 Your Right to Opt Out. You may opt out of this Section 20 by sending written notice within 30 days of the date you first accept these Terms. The notice must be sent to hello@forchics.com with the subject line "Arbitration Opt-Out," and must include your full name and the email address associated with your account or order, and must state clearly that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms and will not affect your account, pricing, or eligibility for any promotion, guarantee, or refund. If you opt out, disputes will be resolved in the courts identified in Section 19.2.
20.10 Fees. Payment of all filing, administration, and arbitrator fees is governed by the AAA rules in effect, including any consumer fee caps. If the arbitrator determines a claim was frivolous or brought for an improper purpose, the arbitrator may reallocate fees as permitted by the applicable rules and law.
20.11 Jury Trial Waiver. To the extent any Dispute proceeds in court rather than arbitration, you and we each knowingly and voluntarily waive any right to a trial by jury.
20.12 Changes to This Section. If we make a material change to this Section 20, the change will not apply to any Dispute for which a Notice of Dispute under Section 20.3 was delivered before the effective date of the change.
20.13 Survival. This Section survives termination of these Terms and closure of your account.
Section 21 - Changes to These Terms
We may modify these Terms at any time. If we make a material change, we will provide notice by posting the updated Terms with a revised "Last Updated" date and, where we have your email address, by sending notice to that address at least 14 days before the change takes effect. Material changes apply prospectively only. Your continued use of the Service, or your placement of a new order, after the effective date constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Service and may cancel any active subscription in accordance with Section 7.
Section 22 - Entire Agreement; Assignment; No Waiver
22.1 Entire Agreement. These Terms, together with our Privacy Policy, Return and Refund Policy, Subscription Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
22.2 Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
22.3 No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
22.4 Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including holidays, natural events, or political disruptions.
22.5 Headings. Headings are for convenience only and do not affect interpretation.

SMS/MMS MOBILE MESSAGE MARKETING PROGRAM TERMS AND CONDITIONS
ForChics (HDH ECOM INC) ("we," "us," "our") offers a mobile messaging program (the "Program"), which you agree to use and participate in subject to these Mobile Messaging Terms and the Privacy Policy at forchics.com/pages/privacy-policy (the "Agreement"). By opting in to or participating in the Program, you accept and agree to these terms, including your agreement to resolve disputes through binding individual arbitration as detailed in Section 20 of our main Terms of Service above. This Agreement is limited to the Program and does not modify other Terms or policies governing your relationship with us in other contexts.
- User Opt In. The Program allows users to receive SMS/MMS mobile messages by affirmatively opting in through online or application-based enrollment forms. By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from us. Message and data rates may apply. Message frequency varies.
- User Opt Out. To stop receiving messages, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from ForChics. You may receive one additional confirmation message. These are the only recognized opt-out methods.
- Program Description. Users who opt in can expect to receive messages about the marketing and sale of our products, including eyelash and eyebrow serums and related items. Messages may include checkout reminders.
- Cost and Frequency. Message and data rates may apply. Message frequency varies. The Program involves recurring mobile messages, and additional messages may be sent periodically based on your interaction with us.
- Support. For support, text HELP to the number you received messages from or email hello@forchics.com. Email is not an acceptable method of opting out.
- MMS Disclosure. The Program will send SMS messages if your device does not support MMS.
- Disclaimer of Warranty. The Program is offered on an "as-is" basis and may not be available in all areas at all times. We are not liable for delays or failures in the receipt of mobile messages. Delivery is subject to your wireless carrier's network and is outside our control. Carriers are not liable for delayed or undelivered messages.
- Participant Requirements. You must have a wireless device capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service.
- Age Restriction. You must be at least 13 years of age to participate in the Program. If you are between 13 and 18, you must have your parent's or legal guardian's permission. By participating, you confirm that you meet these requirements.
- Prohibited Content. You agree not to send any fraudulent, defamatory, threatening, harassing, obscene, or unlawful content through the Program, and not to send any content that implicates protected health information under HIPAA or HITECH.
- Dispute Resolution. Any dispute arising out of or relating to this SMS Program, including disputes involving Stodge, LLC d/b/a Postscript or any other third-party service provider acting on our behalf to transmit mobile messages, shall be resolved through binding individual arbitration in accordance with Section 20 of our main Terms of Service. The class action waiver in Section 20.7 applies fully to disputes under this Program. If for any reason a dispute proceeds in court rather than arbitration, both parties waive any right to a jury trial.
- Florida Law. We endeavor to comply with the Florida Telemarketing Act and the Florida Do Not Call Act as applicable to Florida residents. For compliance purposes, we may treat you as a Florida resident if your shipping address or opt-in phone area code is in Florida. Mobile messages sent by us in direct response to your requests, including opt-in, HELP, or STOP responses and shipping notifications, do not constitute commercial telephone solicitations under Florida Statutes Section 501 to the extent that law is otherwise applicable.
- Miscellaneous. You represent that you have all rights necessary to agree to these terms. Our failure to exercise any right under this Agreement is not a waiver of that right. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remainder of the Agreement will remain in effect. We reserve the right to update this Agreement at any time, and your continued participation constitutes acceptance of any changes.
